Do I Need a Motorcycle License for a 150cc Scooter in California?

March 24, 2025 //  by Dawn Hassell, Esq.

Riding a 150cc scooter in California can be an efficient and enjoyable way to navigate the busy streets of the Bay Area. However, to do so legally, it’s essential to understand California’s licensing and safety requirements. In this article, we’ll clarify whether you need a motorcycle license to operate a 150cc scooter and provide helpful guidance to ensure you stay compliant with state laws.

California’s Definition of a Motorcycle

Under California law, a motorcycle is defined as a motorized vehicle with two or three wheels and an engine size of 150 cubic centimeters (cc) or larger. This classification includes 150cc scooters. To legally ride a 150cc scooter in California, you must obtain an M1 motorcycle license.

Steps to Obtain an M1 Motorcycle License

To legally ride a 150cc scooter in California, follow these steps:

Get a Learner’s Permit:

  • Pass a written knowledge test that covers motorcycle operation and safety laws.
  • If you are under 21, you must hold the permit for at least six months before applying for a full license.

Complete a Motorcycle Training Course:

  • Enroll in and complete the California Motorcyclist Safety Program (CMSP).
  • Upon completion, you will receive a Certificate of Completion of Motorcycle Training (DL 389), which waives the DMV skills test requirement

Pass the Skills Test (if applicable):

  • If you do not complete the CMSP course, you’ll need to pass a skills test at the DMV.

Submit Your Application:

  • Provide proof of identity, residency, and your DL 389 certificate (if applicable).
  • Pay the required fees.

Registration and Insurance Requirements

In addition to obtaining an M1 license, California law requires that all 150cc scooters be:

  • Registered with the DMV: You must register your scooter and obtain a license plate to legally operate it on public roads.
  • Covered by Insurance: Proof of liability insurance is mandatory and must be provided during the registration process.

Helmet Requirements

California law mandates that all riders of motorcycles and scooters, regardless of engine size, wear a DOT-approved helmet at all times. Helmets significantly reduce the risk of serious head injuries in the event of an accident.

Why Compliance Matters

Failure to comply with California’s licensing, registration, and safety laws can result in fines, legal consequences, and increased risks of injury. Additionally, if you are involved in an accident while operating a 150cc scooter without proper licensing or insurance, you may face legal challenges when pursuing compensation for injuries or damages.
